Refund & Cancellation Policy

Datameris IT Solutions Pvt. Ltd. (“Datameris”, “we”, “our”, or “us”) is committed to delivering high-quality technology solutions and professional services. Because many of our services involve customized development, consulting, digital implementation, and ongoing professional work, refund eligibility differs from that of physical products.

This Refund & Cancellation Policy explains the conditions under which cancellations and refunds may be requested. By engaging our services or making a payment, you acknowledge that you have read and agree to this policy.

1. Scope

This policy applies to all services provided by Datameris IT Solutions Pvt. Ltd., including but not limited to:

  • Custom Software Development
  • Website Development
  • Mobile Application Development
  • UI/UX Design
  • AI & Automation Solutions
  • API Development & Integration
  • CRM & ERP Development
  • Cloud & DevOps Services
  • Product Strategy & Technology Consulting
  • Search Engine Optimization (SEO)
  • Digital Marketing Services
  • Google Ads Management
  • Social Media Marketing
  • Branding & Creative Services
  • Website Maintenance & Support
  • Third-party software, licenses, domains, hosting, and subscriptions procured on behalf of clients

Where a signed Proposal, Quotation, Statement of Work (SOW), Master Service Agreement (MSA), or other written agreement contains different refund terms, those terms shall prevail for that specific engagement.

2. Service Cancellation

Clients may request cancellation of a project or service by submitting a written request to hello@datameris.com.

Cancellation requests become effective only after written acknowledgement from Datameris.

For recurring monthly services such as SEO retainers, maintenance plans, or digital marketing subscriptions, cancellation requests should be submitted at least 15 calendar days before the next billing cycle unless otherwise agreed in writing.

Submitting a cancellation request does not automatically entitle the client to a refund.

3. Project Commencement

A project shall be considered commenced when any of the following activities has begun:

  • Discovery or consultation sessions
  • Requirement gathering
  • Technical planning
  • Solution architecture
  • Wireframing
  • UI/UX design
  • Content planning or creation
  • Development sprint allocation
  • Software development
  • Infrastructure provisioning
  • Cloud configuration
  • API integration
  • AI model implementation
  • SEO implementation
  • Digital marketing campaign setup
  • Procurement of third-party services or software

Once project commencement has occurred, refund eligibility shall be governed by the terms of this policy.

4. Refund Eligibility

Refunds may be considered only under the circumstances described below.

Eligible Circumstances

A refund may be considered if:

  • Work has not yet commenced.
  • A duplicate payment has been made and verified.
  • A payment was processed due to a verified technical or payment gateway error.
  • Datameris is unable to commence the agreed project due to reasons solely attributable to Datameris.

Not Eligible for Refund

Refunds are generally not available after any of the following has occurred:

  • Consultation or discovery sessions have been completed.
  • Project planning has been completed.
  • UI/UX design work has begun.
  • Software or application development has commenced.
  • Content development has started.
  • SEO implementation has begun.
  • Digital marketing campaigns have been launched.
  • APIs or third-party integrations have been configured.
  • Hosting or cloud infrastructure has been provisioned.
  • A project milestone has been delivered or approved.
  • Third-party software, licenses, domains, hosting, SSL certificates, or subscriptions have been purchased.
  • Professional consulting hours have been utilized.

Payments for completed work, professional services rendered, consulting, implementation activities, and third-party expenses are non-refundable.

5. Partial Refunds

If a project is cancelled before completion, Datameris may evaluate whether a partial refund is appropriate.

Where approved, the refundable amount will be determined after deducting:

  • Completed project milestones
  • Professional consulting hours utilized
  • Development work completed
  • Design work completed
  • Documentation prepared
  • Project management efforts
  • Quality assurance and testing activities
  • Third-party software or licensing costs
  • Domain registration fees
  • Hosting charges
  • Cloud infrastructure costs
  • API usage charges
  • Payment gateway fees
  • Administrative expenses where permitted by applicable law

Only the unused portion of prepaid service fees, if any, may qualify for a refund.

6. Non-Refundable Items

The following items are non-refundable once purchased, activated, delivered, or utilized:

  • Domain registrations
  • Website hosting
  • SSL certificates
  • Cloud infrastructure charges
  • Software licenses
  • Premium plugins
  • Third-party subscriptions
  • API usage charges
  • Advertising spend
  • Government fees
  • Taxes already remitted where non-refundable under applicable law
  • Completed consulting sessions
  • Completed training sessions
  • Completed project milestones

7. Client Responsibilities

Clients are responsible for:

  • Providing complete and accurate project requirements.
  • Supplying necessary content, credentials, and approvals.
  • Reviewing deliverables within agreed timelines.
  • Providing feedback promptly.
  • Making payments according to agreed schedules.

Delays resulting from incomplete information, delayed approvals, or lack of client response do not qualify for refunds.

8. Changes to Project Scope

If project requirements change after work has commenced:

  • Additional work may require revised pricing and timelines.
  • Previously completed work remains payable.
  • Refund eligibility shall not apply to completed milestones.
  • A revised quotation or agreement, once accepted, supersedes the previous scope.

9. Project Suspension or Termination

Datameris reserves the right to suspend or terminate a project if:

  • Payments remain overdue.
  • Required client information is not provided.
  • The client materially breaches contractual obligations.
  • The project involves unlawful, fraudulent, or prohibited activities.
  • Continuing the engagement would violate applicable laws or regulations.

Payments received for completed work remain non-refundable.

10. Refund Request Procedure

Refund requests must be submitted in writing to hello@datameris.com and should include:

  • Client name
  • Company name (if applicable)
  • Project name
  • Invoice number
  • Payment date
  • Payment reference
  • Reason for the refund request
  • Supporting documents, where applicable

Datameris may request additional information to verify the request before processing.

11. Refund Review & Processing

Refund requests are generally reviewed within 5 business days after all required information has been received.

If approved:

  • Refunds will be processed through the original payment method wherever possible.
  • Refund processing generally takes 7–14 business days, subject to banking institutions and payment gateway processing times.
  • Where permitted by law, payment gateway fees, bank charges, taxes, and third-party transaction costs may be deducted from the refundable amount.

12. Intellectual Property

Unless otherwise agreed in writing, ownership of project deliverables transfers to the client only after full payment has been received.

If a project is cancelled before full payment, Datameris retains ownership of all unfinished work, source code, designs, documentation, and related intellectual property.

13. Force Majeure

Datameris shall not be liable for delays, suspension, or failure to perform services due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, internet outages, cyber incidents, labor disputes, epidemics, or failures of third-party service providers.

14. Consumer Rights

Nothing in this policy limits or excludes any rights available under applicable consumer protection laws. Where mandatory legal protections apply, those rights shall prevail over any conflicting provision of this policy.

15. Policy Updates

Datameris may revise this Refund & Cancellation Policy from time to time.

The updated version will be published on our website with a revised Last Updated date. Changes apply prospectively unless otherwise required by law.
